Supporting Evidence
As already stated, the complainant stated in cross-examination that he had acquaintance with the accused in connection with the sale of gold ornaments by the accused in the Jewellery Shop run by the complainant. He further stated that the amount was paid to the accused as advance sale consideration in connection with the purchase of property by the complainant from the accused. The complainant has narrated the details of payment made by him and the repayment of part of the amount by the accused. No suggestion was put to PW1 in cross-examination that there was no property transaction as stated by the complainant.
Judgment Evidence:
On the basis of foregoing discussions and evidence on record, I am of the view that the complainant has successfully established that the accused executed and issued Ext.
